Understanding Harassment at Work

Title VII of the civil rights act of 1964 prohibits discrimination by covered employers on the basis of race, color, religion, sex or national origin. Title VII also prohibits discrimination against an individual because of his or her association with another individual of a particular race, color, religion, sex, or national origin.

What constitutes job harassment in Camden County?

According to the U.S. Federal Communications Commission (FCC), work harassment resulting in a hostile or offensive work environment can include:

  • Use of racially derogatory words, phrases, epithets
  • Demonstrations of a racial or ethnic nature such as a use of gestures, pictures or drawings which would offend a particular racial or ethnic group
  • Comments about an individual’s skin color or other racial/ethnic characteristics
  • Making disparaging remarks about an individual’s gender that are not sexual in nature
  • Negative comments about an employee’s religious beliefs (or lack of religious beliefs)
  • Expressing negative stereotypes regarding an employee’s birthplace or ancestry
  • Negative comments regarding an employee’s age when referring to employees 40 and over
  • Derogatory or intimidating references to an employee’s mental or physical impairment

Proving that the harassing conduct was severe enough to alter the working conditions and to create an abusive work environment involves meeting both a subjective and an objective standard. The subjective standard means that the victim found the conduct to be bad enough to interfere with his/her ability to do the work. The objective standard involves testing whether a reasonable person in the same position would have thought the conduct severe or pervasive.

What Should You Do?

Even if you are not sure office harassment has happened, as soon as possible after the incident has happened, record the date, time, place, and who was present. Be as detailed as you can about what was said and what was done. If you need to file a claim, this record will be very important to the case.

Write up a complaint and give it to a supervisor or manager, following the company workplace harassment grievance policy if there is one. Keep a copy of the complaint for your records. If the problems persist, keep recording the facts, because it may be time to talk to attorney Leo B. Dubler about your Camden County harassment lawsuit.

Work Harassment: Myths & Mistakes

If someone tried to tell you one of the following whoppers when you spoke up about being harassed in your workplace, it’s time to take action:

  • “This wasn’t workplace harassment; it wasn’t done to you by your co-workers”
  • “You can’t call this harassment; there was nothing sexual about it.”
  • “You weren’t harassed because no one touched you.”
  • “You can’t complain to management yet; you have to directly confront the person who is harassing you first.”
  • “You brought this on yourself through your words/actions.”
  • “Nobody got hurt; what’s the problem?”
  • “It was bound to happen with everyone working together for this length of time.”
  • “Maybe we could have prevented it, but it would have been too expensive.”

Be careful who you get advice from about your complaint. Co-workers and managers will have different points of view; some will want you to drop your complaint because it’s less troublesome for them, and some mean well but have a poor understanding of the law. Get all the facts you need from a skilled and experienced lawyer who can help you assess your case.
