Understanding Whistleblower and Qui Tam Claims

Anyone who objects or complains about activities in the workplace that they believe to be illegal or improper is considered to be a whistleblower. Whistleblower claims often involve employees who report or threaten to report activities to government regulators or law enforcement agencies. In many cases, employers retaliate against whistleblowers by terminating their employment, demoting them or otherwise subjecting them to harassment.

Fortunately, New Jersey has a very powerful law, called the Conscientious Employee Protection Act, that is specifically designed to protect whistleblowers. This law, known as CEPA, even allows whistleblowers to collect attorneys’ fees and costs against their employers if their claims are successful.

The federal False Claims Act also provides incentives for whistleblowers to come forward. Under the FCA, those who file claims for fraud against federal contractors on behalf of the federal government may be entitled to a portion of any amount recovered as a result of their lawsuit. These suits are known as “qui tam claims.”
